Use of Force in Making Arrest (Criminal Procedure Act, Cap. 20 R.E. 2022)

Section 21 regulates the use of force during an arrest, establishing clear guidelines for police officers and other authorized persons involved in making an arrest.

Subsection (1) requires that a police officer or authorized person must not use more force or subject the individual being arrested to greater indignity than necessary. The force used should only be sufficient to effect the arrest or prevent the escape of the individual after the arrest has been made.

Subsection (2) further clarifies that a police officer must not perform any act likely to cause the death of the individual being arrested, unless the officer has reasonable grounds to believe that such an act is necessary to protect life or prevent serious injury to another person. This provision ensures that the use of deadly force is only justified in situations where it is necessary for self-defense or the protection of others.
