Refusal to Give Name and Residence (Criminal Procedure Act, Cap. 20 R.E. 2022)

Section 29 outlines the procedures when an individual refuses to provide their name and residence upon demand by a police officer:

Subsection (1) allows a police officer to arrest a person who, in their presence, has committed or has been accused of committing a warrant offence and refuses to give their name or residence. If the officer has reason to believe the name or residence provided is false, the officer may arrest the individual to verify their identity and address.

Subsection (2) provides that once the true name and residence of the arrested person have been confirmed, they must be released upon executing a bond to appear before court if required. If the individual is not a resident of Tanzania, the bond must be secured by a surety or sureties who are residents of Tanzania.

Subsection (3) stipulates that if the true name and residence of the arrested person have not been determined within 24 hours, or if they fail to execute the bond or provide sufficient sureties, they must be taken to court immediately.

This section ensures that individuals who attempt to evade identification or fail to provide valid information are properly handled, balancing their right to due process with the need for law enforcement to confirm their identity.
