Arrest of Vagabonds, Habitual Robbers, etc. (Criminal Procedure Act, Cap. 20 R.E. 2022)
Section 28 empowers the officer in charge of a police station to arrest or cause the arrest of individuals under specific circumstances:
Subsection (a) allows for the arrest of any person found taking actions to conceal their presence within the station's limits when there is reasonable belief that such actions are intended to facilitate the commission of an arrest able offence.
Subsection (b) permits the arrest of any individual within the station's jurisdiction who has no apparent means of subsistence or is unable to satisfactorily explain their presence or activities.
Subsection (c) targets individuals known by reputation to be habitual offenders, such as habitual robbers, housebreakers, thieves, or receivers of stolen property. It also includes those who habitually engage in extortion or cause fear in others to commit extortion.
This section focuses on apprehending individuals whose behavior or reputation suggests a likelihood of engaging in criminal activity.
