Accused, an employee of the East African Community, stole money from the community and was convicted of stealing by a person in the public service c/ss 270 and 265, Penal Code. The trial court held, however, that accused was not employed in the public service within the meaning of the Minimum Sentences Act, and so was sentenced to only 18 months imprisonment.
Held: An employee of the East African Community is clearly a person employed in the public service within the meaning of the Minimum Sentences Act. Sentences enhanced to 2 years imprisonment with 24 strokes.
