Accused asserts that he was not permitted to call certain witnesses, or to produce certain physical evidence. He seeks to have his case reopened so he can fully defend himself.
Held: “There is nothing on the record to show that (accused) was given the opportunity to call witnesses and that he declined to do so. As there may be some merit to (accused ’s) complaints …. and as such evidence may affect the merits of this case …. the Court ordered that the record of the case be transmitted to the district court for the hearing of further evidence.
