R.v. Daudi James, Crim. Rev. 148-D-67, 14/11/67, Duff J.

It is alleged that accused has three relevant previous convictions. Accused denied these convictions. The prosecution sought to prove these by tendering a certificate of comparison of fingerprints which had been sent by the authorities in Dar es Salaam. The court accepted this proof, and took the previous convictions into account in assessing sentence.

            Held: The mere production of a certificate of comparison of fingerprints” …… does not constitute prima facie evidence of all the facts set out in the document,” unless it is produced by the person who took the fingerprints of the accused.
