Accused was convicted of entering dwelling house with intent to steal and with stealing. [P.C. ss. 295,265.] There was no breaking or attempted breaking, and the property stolen belonged to a private individual. The trial court directed that accused receive ten strokes of corporal punishment under section 5(2) of the Minimum Sentences Act.
Noted; The provisions of the Minimum Sentences Act were inapplicable to this case and the sentence was improper
