The Functions of the Commission for Mediation and Arbitration in Tanzania



Introduction:

In Tanzania, the Commission for Mediation and Arbitration (CMA) plays a crucial role in the resolution of disputes between employers and employees. Established to provide an alternative to the conventional court system, the CMA is tasked with promoting harmony in the workplace and ensuring that labor-related conflicts are resolved efficiently and fairly. This article aims to shed light on the functions and significance of the Commission for Mediation and Arbitration in Tanzania.

Mediation Services:

One of the primary functions of the CMA is to offer mediation services for labor disputes. Mediation involves a neutral third party, the mediator, facilitating communication between the conflicting parties to help them reach a mutually acceptable agreement. The CMA provides skilled and impartial mediators who assist in fostering open dialogue, identifying common ground, and finding amicable solutions to disputes. Mediation is often preferred as it is a voluntary and non-adversarial process, allowing the parties to maintain a working relationship after resolution. See section 14(1)(a) of Labor Institutions Act CAP 300 of 2020.

Arbitration Proceedings:

The CMA also conducts arbitration proceedings when mediation fails to resolve the dispute. Arbitration is a more formal process where an impartial arbitrator or a panel of arbitrators makes a binding decision based on the evidence and arguments presented by both parties. The CMA's role in arbitration is to ensure a fair and unbiased hearing, guiding the parties through the process and ultimately issuing a legally enforceable decision. This mechanism provides a faster and less formal alternative to traditional court litigation. See section 14(1)(b) of Labor Institutions Act CAP 300 of 2020.

Trade Dispute Settlement:

The CMA specializes in settling trade disputes, including those related to employment contracts, working conditions, and other labor-related matters. By providing an accessible platform for dispute resolution, the CMA contributes to the stability and growth of industries in Tanzania. Timely and efficient resolution of trade disputes helps maintain a conducive environment for business operations and fosters a positive relationship between employers and employees.

Training and Capacity Building:

In addition to its dispute resolution functions, the CMA is actively involved in training and capacity building. The commission conducts workshops, seminars, and training programs to enhance the understanding of alternative dispute resolution methods among employers, employees, and their representatives. By promoting awareness and imparting relevant skills, the CMA aims to prevent disputes and encourage a culture of effective communication and conflict resolution in workplaces.

Research and Policy Development:

The CMA engages in research activities to stay abreast of evolving trends in labor relations and dispute resolution. Additionally, the commission plays a role in advising the government on policy matters related to mediation and arbitration. This ensures that the legal framework governing labor disputes remains relevant and effective in addressing the dynamic needs of the Tanzanian workforce.
