Satima Chimbe v. Luhi Murasei, (PC) Civ. App. 67-D-67, 31/8/67, Saidi J.
Plaintiff claimed cattle and goats which he allegedly handed over to defendant in 1948 for safekeeping. He was awarded six cattle and appealed, contending that the judgment was insufficient. The action was filed on 5th December 1966.
Held: The claim was time barred and should have been rejected outright by the trial court. The limitation period was three years under the Customary Law (Limitation of Proceedings) Rules 1963. Appeal dismissed with costs.
