The accused were convicted of being rogues and vagabonds
[P.C. s. 177(4)]. Maximum penalties of 3 months’ imprisonment were imposed. Both were first offenders.
Held: Only in the most unusual circumstances should the maximum penalty be imposed on a first offender. Sentences reduced to result in immediate release.
