Accused was convicted of housebreaking and sentenced to 2 years and 24 strokes, pursuant to the provisions of the Minimum Sentences Act. Accused was a first offender; the value of the property taken was Shs. 10/-
Held: The smallness of the value of the stolen property is in itself a special circumstance so section 5 of the Act is applicable here. Sentence reduced to 6 months imprisonment, no strokes.
