Mohamed s/o Ally v. Amina d/o Saidi, (PC) Civ. App. 77-D-67, 30/8/67, Saidi, J.
Plaintiff assaulted his wife in 1965 and she left him. In 1966 he brought this action for restitution of conjugal rights. The wife did not challenge his claim, but she sought, and was awarded, Shs. 34/- as compensation for money which she had spent out of her original family’s funds for her support during the separation.
Held: Plaintiff admitted he had assaulted defendant. So long as she is his legal wife, he is responsible for maintaining her, “and it matters little whether she is living separately.”
