Accused was convicted under Penal Code, section 114 (a), with obstructing a court messenger in the execution of a search warrant.
Held: This section is in respect of contempt of court within the premises in which any judicial proceeding is being had or taken. It does not apply to obstructing the execution of a search warrant. The conviction was quashed.
