The judgment of the trial court magistrate referred to the witnesses by number only – e.g., P.W. 4, D.W. 1, etc – and not by name.
The Court noted: Witnesses should always be referred to both by name and number, e.g., “Makanga bin Ali, P.W.2.” if only the numbers of the witnesses are used, much confusion can be caused if the numbers are wrongly written.
