The plaintiff, who alleged that she had a child by the defendant, sued for specific performance or, alternatively, for damages, for his breach of promise to marry her. She was unsuccessful in the Kadhi’s court, where her claim was dismissed for failure to prove the promise. The High Court Agreed that the promise had not been proven.
The Court stated obiter: Specific performance of a marriage can no longer be decreed in any country. The only action available for breach of a promise to marry would be one for damages.
