What is collective punishment?



Collective punishment in Tanzania is governed by the collective Punishment Ordinance, 1921, Cap. 74. It is a punishment of fines imposed under section 2 Cap 74 by the President of Tanzania on all or any village, area or district or members of any tribe, sub-tribe or community. The President may impose collective punishment after the inquiry, he is satisfied that say, members of the community: 

a). All or any of them have colluded with or haboured or failed to take all reasonable means to prevent the escape of any criminal; 

b). They or any of them have suppressed or combined to suppress evidence in any criminal case; 

c). That the stolen property having been traced to within the limits of any village, area or district, they have failed or neglected to restore the property or to trace it beyond the limits of such village, area or district.
