What happens to the proceedings in Civil suit when the witness has been taken to jail?



Where the witness to the Civil suit has been taken to jail, the court may on the application of either party or on its motion issue summons to witness to such witness through the officer in charge of the prison where the witness has been jailed and such officer shall serve the summons to the said witness. 

Note: Where hearing has commenced, the hearing of evidence of such witness will be adjourned till the jailed witness appears as ordered in the summons. 

Note also that; Order V Rule 24, of the Civil Procedure Act, applies Mutatis Mutandis where the witness has been jailed or where he is in prison.
