What do you understand by bail pending appeal?



Bail Pending appeal is the temporary release of the accused person convicted of the offence by subordinate court pending the hearing and determination of the appeal. However, in order the accused appellant to succeed in his application for bail pending; he must show that there is an overwhelming chances of appeal succeeding. See Republic vs. Nicholas Alfred Kiyabo [1987] TLR. 39. Bail pending appeal is required to be applied for when the appeal has commenced according to law. See DPP vs. Ally Nur Dirie & Another [1988] TLR 252.
