Under what circumstances can a minor be compelled to pay for goods he took under credit?



Under section 11(2) of the Law of Contract Act, Cap. 345. An agreement by a minor is void because a minor is incompetent to contract, however, section 4 of the Sale of Goods Act and section 65 of the Law of Contract Act, provides for circumstances where the minor is required to pay goods he took under credit. Both provisions says that; where the minor is supplied with necessaries will be required to pay for them. 

Note: section 4 of Cap.214 requires minor who has enjoyed some benefit that is necessary to him according to his situation in life to pay. Section 68 of the law of Contract says that, the person supplies necessaries to minor or incapable person becomes entitled to be reimbursed from the property of that minor or incapable person. Note also that; It may be said that, necessaries are things or services without which an individual cannot reasonably exist, e.g. food and shelter.
