Jus Acrescendi, Mutatis Mutandis, and Grant Pendent lite.




Jus Acrescendi

Jus accrescendi simply refers to the right of accrual. It is the right of a joint owner of property to acquire absolute ownership of the entire property on the death of the other owner(s). 

Mutatis Mutandis;

Mutatis Mutandis refers the necessary charges being made; Example, the provisions of letter of a statute may repeat the provisions of the former statute Mutatis Mutandis, that is , necessary charges are made in the letter statute to suit the prevailing conditions. 

Grant Pendent lite;

Grant Pendent lite; it is found under section 38 of the Probate and Administration of Estates Act Cap 352. It means Court appoints administrator of the Estate of the deceased person who shall have the rights and general powers of general administration other than the right of distributing such estate pending the determination of any proceedings touching the validity of the will of a deceased person or for obtaining or revoking any probate or any grant of letters of administration. The person appointed shall be subject to the immediate control of the court and shall act under its directions.
