Guardian ad litem, is a person appointed to defend an action or other proceeding or on behalf of minor or person under disability. Guardian ad Litem is appointed by the Court. Order XXXI Rule 3(1) of the Civil Procedure Act. it empowers the Court to appoint a Guardian for suit where the minor is a defendant. Also the Court is empowered to appoint the Guardian for the suit where the defendant is of unsound mind. See Rule 15 of Order XXXI of CPC.
