Flagrante Delicto; is a latin maxim meaning the very act of committing a crime, meaning in the of an offence. The phrase is most commonly applied to a situation in which a person finds his or her spouse in the act of committing adultery. A person who kills his or her spouse in this situation he may have a defence of provocation.
