Mens rea refers to a guilty mind. It is an evil intention, or knowledge of the wrongfulness of an act. It is a state of mind that the prosecution must prove a defendant to have had at the time of committing a crime in order to secure a conviction. It is presumed an essential ingredient in every criminal offence, liable to be displaced either by the words of the statute or by the subject matter with which it deals.
