The term criminal responsibility refers to ones liability for the act or omission constituting an offence. It is the liability which is in criminal law punishable upon the court finds the person to guilty.
Who is not criminally responsible under Tanzanian law?
The following are not criminally responsible under Tanzanian law:
1). The President of the United Republic of Tanzania. See article 46(1) of the Constitution of Tanzania;
2). The under 10 years persons, see section 15(1) of the Penal code as replaced by SOSPA, 1998;
3). Members of Diplomatic Mission;
4). Insanity as per 13 of the Penal Code.
