Adjournment of Civil cases.



Adjournment of Civil cases is governed by Order XVII of the CPC. This Order says that, the court has the discretion to decide whether or not a case fixed for hearing should be should be adjourned. But since the discretion to adjourn hearing of a case is judicial, it follows that, the court is required to exercise it discretion judicially. The Order allows also the Court to adjourn the case sine die. See Order XVII, rule 4 of CPC. Adjournment of cases can be made either on the courts’ motion or at the instance of the parties or any of them.
