When an appeal may be summarily dismissed?



The  appeal  may be summarily dismissed in  the following circumstances

1).  Where appeal  must be with leave of high  Court and no such leave  is sought  and obtained.  See  section 5(1)(c)  of Appellate Jurisdiction Act,  1979.

2).  Where memorandum of Appeal  is not  accompanied  by a  copy of Decree  appealed from.  See  Order  XXXIX, Rule  1(1)  of  Civil Procedure  Code also  H.S.  Stanley &  Sons Ltd  vs.  Alli  Ramadhani, 1988  TLR. 250.,  see again Juma  Ibrahim Mtale vs.  K.G.  Karmali, 1983  TLR. 50,  where Court  of Appeal  struck  out  appeal  for  non compliance  with rule  80(2) of Court  of Appeal  Rules,  1979.
