The elements of a tort for malicious prosecution that, the plaintiff must prove against the defendant are:
1). That he was prosecuted;
2). That the proceedings complained of ended in his fovour;
3). That the defendant instituted a prosecution maliciously.
4). That there was no reasonable cause for such a prosecution; and
5). That damage was occasioned to the plaintiff. Note: The five elements above for the tort of malicious prosecution were enumerated by justice Chipeta in. Jeremiah Kamama vs. Bugomola Mayandi,1983 TLR 123.
