The 3rd party procedure is the procedure by which party who is not an original party (privy) to the proceedings is brought to the suit by the defendant on a ground that in case that the original defendant is found liable the party so brought into the suit will have to contribute or indemnify the defendant. A defendant has to apply for leave to present to the court a 3rd party notice per Order 1, Rule 14(1) of the CPC.
3rd Party Procedure differs from rejoinder of a party in that, 3rd party procedure is only initiated by the defendant, where as; rejoinder of a party may be initiated by the application of either party to the suit or by the court.
