The ingredients of theft.

The ingredients of the offence theft are provided in section 258(1) of the Penal Code. This is the section that creates the offence of theft and the ingredients are: 

1). Any person who fraudulently and without claim of right; 

2). Takes; and anything capable of being stolen is said to steal the thing.

Or

Any person who fraudulently and without claim of right; Converts to the use of any person other than the general or special owner thereof; anything capable of being stolen…. is said to steal the thing.
