Habeas Corpus refers a prerogative order directed to a person who detains another in custody and commands him to produce or have the body of that person before the court. It is invoked only when the person are detained but not properties, as per provision of section 285 of the Criminal Procedure Act and Adam Mwaibabile vs. R [1997] TLR 96.
