Extended Jurisdiction is governed by the provisions of section 45 of the Magistrate Court Act and sections 173-176 of the Criminal Procedure Act. According to section 45 of MCA and section 173 of CPA, the Minister for Legal Affairs may invest any Resident Magistrate the powers to try any category of the cases or any particular case ordinarily triable by the High Court. The Minister invests any Resident with Extended Jurisdiction by order which must be published in the Gazette. The cases which the Resident Magistrate has been invested powers to try are specified in the Order ……; and section 45(1) of the MCA provides that; The Minister will exercise his power under the same provision offer consultation with the Chief Justice and Attorney General whereas; section 173 of Criminal Procedure Act provides that the Minister in exercising of his power may seek recommendation of Chief Justice or in his absence, the senior Puisne Judge.
