Case stated refers to the written statement of the relevant fact in a case submitted for the opinion or judgment of superior Court. After the hearing and decision of a case, the part to the case may quest Court or Tribunal to state a case for the opinion or judgment of the superior Court. Sometimes case started is referred to a special case.
In Tanzania Case Stated is governed by Section 65 and Order XXXIV of CPC. Order XXXIV Rule (v) provides that parties may by agreement in writing state questions of facts or law in form of case for the opinion of the court.
