When may the Court require the furnishing of security for costs?



The Court require the furnishing of security for costs in any of the following circumstances: 

i). Where the appellant is residing out of Tanzania and is not possessed of any sufficient immovable property within Tanzania per Order XXXIX, r. !0 (1) of the Civil Procedure Act; 

ii). Where the party is suing on behalf of someone who will be unable to pay the defendant’s costs if ordered to do so; 

iii). Where the defendant address is dishonestly not stated or incorrectly stated on the Pleading; or 

iv). Where the Plaintiff charges his address during the course of proceedings in order to erode the consequences of the litigation.
