The effect of failure by the accused person to make a defence after a prima facie case is made against him, is governed by the provision of section 231(3) of Criminal Procedure Act, that is; the court will be entitled to make adverse inference against the accused person and the court as well as the prosecution shall be permitted to comment on the failure by the accused to give evidence.
