The difference between primary and secondary evidence is that:
Primary Evidence is defined in section 64(4) of Evidence Act. It means document itself produced for inspection by court. It means document itself produced for inspection by court. Primary evidence must be generally be produced in court.
Secondary Evidence is defined in section 65 of the Evidence Act; it is a copy of original document. Secondary evidence is only produced in court in exceptional circumstances.
